Why do you need a (decent) workcover lawyer?

Do I need a lawyer?  Yes!  This is the number one question asked by just about every (more seriously *) injured worker, and we say this without the slightest hesitation.  The only bargain or leverage you’re going to find in this sick and twisted system, is your right to have a lawyer of your choice represent you. There are many lawyers in the states but you need to make sure you have the right one lawyer with the right background. Looking a little further, there aren’t a great deal of Social Security Disability Lawyers, I did some research and I had found some useful results. Without a lawyer specialising in workers’ compensation, you basically have little to no chance of getting what is rightfully yours – it’s that simple.

You see workcover insurance companies use nothing but a form of “anti- compensation terrorism” that starts the minute you enter the system, especially once you start claiming for lost time.

Your weekly payments start getting late for no reason and your endless calls to your case manager get you nowhere.  You then call your state’s workcover authority – for example the Victorian WorkSafe “Advisory Service” and they’re on a break or really can’t help you unless you have a ‘denial notice’ (for conciliation).  Weeks go by, still nothing… you and your family now struggle to put food on the table… the panic really sets in.  What do you do? Take it from us, get a lawyer  at the first sign of trouble! Decent lawyers will help you with ensuring you obtain what is rightfully yours (such as weekly pay, home help, taxi, physio, even surgery etc) as part of their service (and usually at no extra cost).

Worker’s compensation (or personal injury) lawyers are actually your very last line of defense against a multi-billion dollar, profiteering workcover-insurance industry.

First consultations are free of charge, so ‘shop’ around if you don’t feel comfortable with the first (couple) you consult.

You’re probably wondering why the authors (and the founder) of such (yes, totally amazing) blog on the ins and out of workcover compensation is telling to get a lawyer.  We can tell you the reason why you need a lawyer in three little but big meaning words: “insurance company lawyers”aka the defence lawyers (see below for a list) for the very deep pocketed workcover insurance companies.  Most of the trouble injured workers will eventually face with their workcover claims – i.e. comes settlement time for example – can be traced directly to these parasites, excuse our French, defense lawyers.

Many of those defense lawyers  have probably caused more pain and suffering to injured workers than any combined physical and psychiatric injury or trauma imaginable. They’re immoral, their job is immoral and they are ruthless.

Unless you know your rights and how to protect them, defense lawyers for the insurance company will pay their bills with your mistakes.  Please don’t make it easy for those immortal parasites defense lawyers, get a good lawyer.

(* by more seriously we mean, more than just spraining your ankle or suffering from for example a broken leg that will heal with no complications within 4-6 weeks)

What is a decent lawyer?

In a nutshell there are basically only two kinds of lawyers: Those who remember your name and those who don’t – simple! Those who rip injured workers off fall under those who don’t remember your name.

Some workers comp lawyers are definitely the real thing.  They care about their clients – us – the injured workers. Unfortunately those genuine, caring lawyers are harder and harder to find.

The worst lawyers are the assembly-line-factory-type lawyers or law firms (aka sharks or ambulance chasers).

They are strictly in the business for the quick money.

They represent hundreds of injured workers at one given time, so many that we know of one such a lawyer talk five injured sods into settling in one and a half hours!  This shark- by the way -also had to have his PA call out the injured workers’ names before he went into “conference” mode, because he couldn’t even remember their faces or their claims! These lawyers often talk about “take it and run” – be very very careful!

  1. Exactly. The people need to unite and take on the cesspool of slime in government. Not just to change legislation as they can’t even uphold that. To force them into accountability over their actions and failure to uphold the law and legal rights/entitlements as well. How are we organising off here?     • Don’t know what protomail is but can look into it. There are things that can be done but remember we are probably all in different states schemes plus there’s comcare and some self-insurers. People have suggested using VPN’s and it might be an idea if we get another website up and running as this one is no longer active by the owner (hopefully they will keep it because it contains so much wonderful information). Otherwise it’s probably a good idea to get an anonymous email account from gmail, hotmail, yahoo or the like that cannot be traced in any way to your own personal information or perhaps have someone else do it for you. I will speak to Trades Hall here and see if the ACTU are on board with helping us. What do u think?

  3. im 100% in on all the above, im from newcastle area hunter valley and before i die i hope to bring those accountable for there corrupt actions, i want these grubs to see what its like to be stripped of everything the have worked hard for, they had want to thank god they are breathing at night, if i ever get non-operative cancer a few medical people had want to sleep with there eyes open or move countrys. ive had enough and im not going quietly

    • Troy, we’re trying to start a group in Vic atm and amalgamate all the groups Nationally. The WorkCOver Scheme will vary depending on what State you are from or like ComCare for Commonwealth employee’s. They’re all pretty much the same. The good news for you though is that there is a very active group in NSW and they have made lots of progress. It’s the Injured Workers Support Network, here is a link to their site. They run meeting in regional area’s as well. Check them out, they might be able to help.

  4. So how many people do we have here seriously happy to move to a new site and active forum and possibly have group support meetings in person? There has been so many come and go and a lot of people are angry and fed up but not a lot of peple are prepared to follow through. It is completely within our means to band together and address these issues but the one of us who have been involved before (also suffering illness and fighting the system) cannot do it alone. Please post on here if you are:
    1. Interested and prepared to participate
    2. Be prepared to use an online forum to share info and help others (without revealing your identity as much as possible)
    3. Possible meet in person and perhaps do some protests or community awareness campaigns.
    4. Join a workgroup to work together to change the Legislation and Claims Management processes by getting the power away from the self-regulating WorkCover Authorities.
    5. What State and Scheme you are in eg. VIC WorkSafe

    Will check back shortly. A Class Action is a very difficult Legal Case to run given the power of an Authority that self regulates itself. There are other ways tho.

    • Hello, I’d be extremely interested in any groups in Queensland. There are two of us who have both suffered psychological injury over a period of up to five (5) years as a result of the same perpertrator at the same time – a narcossist and bully. I also have clear evidence of WorkCover not sufficiently assessing my claim, so much so that their decline advice is based on information that is not accurate at all.

    • I am definitely interested. I am i Victoria. About an hour out of Melbourne. A 5 minute walk from a country train station.
      I believe that a way can be found to fix the “system”.
      The starting point I believe is to find a way to take the Insurance Agents to Court and win against them for unconscionable conduct.
      If the system becomes unprofitable to them tbey will leave it.

      • Hi John, Unfortunately the Insurers won’t leave the Scheme because the Scheme would collapse. The way to ensure the Scheme is changed is through changes to the Legislation. The problem is that the Authority is “self-regulating”, i.e. they are not going to prosecute themselves. This is a Government Scheme and it’s a “cash cow” for the Government (as well as those they pay to run it i.e Insurers, IME’s PI’s etc). Changes can be achieved but we as injured workers must unite and stand together. I do know of ways but obviously not going to post them on here atm. Will be in touch via email.

  5. mate due to incompetent untrained assessors etc capacity is the problem, i went to 1 of insurers ime gave me 14% + 1% for home duties, they sent me to my IME 25% they wouldnt accept either WCC sent me to Dr Myers he gave me 21mins his time said that while i can stick a needle and draw blood on both legs states nothing he gave me 4% they still cant explain the drop in percentage except WWC stated it (CRPS) there was not enough evidence yet i went 2 weeks later see Specialist Westmead syd, he stated its spreading.. GO figure PURE CORRUPTION ! i got myself off them drugs they accounted for 50% of my personality change, i miss family birthdays etc, even my best mates wedding i was best man could only wear shoes for the church, i would rather and i do put up with and try to ease the pain by tailoring my daily movements and how i do things, id like to stand at the sing and wash the dishes without getting sharp pain up legs and lower back, or sleep for more then 4 hours straight, see these grubs dont see what goes on inside our walls the pain, no sleep passing , laying on tile floor for comfort, sitting in the hottest water i can to try relieve some pain sometimes for hours, yes well im more then happy to do what ever we need to do but like i said we need numbers

    • Please don’t think that if the insurers eventually agree that you have no capacity to work and you are issued with a serious injury certificate that that will be the end of you problems.

      I have been issued with a serious injury certificate by Workcover, they didn’t challenge it as all their doctors said I could never work again. Workcover then offered my a payout of $0.00, that’s right, zero.

      The next step is court to have a judge make a decision which will take another 2 years to get to court. In the meantime I have lost my home and have no savings left. I am going to the soup kitchen for meals and salvo’s for assistance. It is disgusting how they treat those injured in the workplace.

      The solicitors representing me and the solicitors representing workcover are in it for themselves. They will rack up the costs for the next two years and settle on the steps just before it goes into court. They will charge me an arm and a leg for it. Bloodsuckers.

      They have no idea of what an injured worker goes thru, it’s all just tactics and a game to them.

    This is all utterly unacceptable, and you are right—we need to organise as a group to demand change and demand accountability.

    The government are malicious Ponzi scheme operators and are negligent at best. Yes, letters to MP’s, Ombudsman, IBAC etc. Also I think a class action in every state is far overdue.

    The treatment the government dishes out, and its wilful failure to disregard the law in favour of Ponzi scheme profits is reprehensible. They rely on bullying and lying to individuals with far less resources than them. In a class action, the tables would be turned (and legal expenses minimised per person).

    The misconduct of government is ruining lives, livelihoods and families, and causing suicides. They know this, and the only problem they see is that they should be screwing more people over. Government should be hung.

  7. your words, pain,stress, disbelieve, disappointment & disarray are like so many James, the system is corrupt as F**K and they dont care how they treat injuried people in any way shape or form, we all need to write to Sen Jacqui Lambie ( tasmania SP ) Jacqui has/had Chronic Regional Pain and she brought it to Parliament about the effects of living with daily pain the mental side of things, pressure on familys , etc and how her life (like ours) has to try and learn to live with this crap and change the way we live on a daily basis, in saying that she is only one person maybe we could be heard alot louder if we band together, maybe start petition on line to have more mods in the AMA with CRPS, corruption in the work cover system, the change of laws with in the work cover system.

    the system works for work cover and the employer not the injured, ive been off for 7yrs i can never return to work had 3 ops on R knee also taking grafs from L leg, at this point i need a full knee replacement R leg, reconstruction L knee and dorsal up the spine to maybe at least relieve some pain for maybe some type quality life, the CRPS is travelling up my right side through my buttocks the back through to my R arm, elbow fingers etc, and i went to 2 PIA on my side got 24% and 18%, went to 2 from WCC they gave me 14% + 1% home duties and the other 4% mind you he was a Heart Surgeon but because he done his course for P I A gives him right to assess Orthopedic ( look at differnce between the 2 assessments which were 9wks apart 11% go figure that one) the other 3 were PIA’s but Orthopedic Specialists in there trained field, well the WCC went with the 4% and final decision, so no pay out, lost my health well being, dignity, self esteem my nature, virtually my family they say im a completley different person now, daily pill in take doctor / specialist appointments ability to enjoy my grand kids to full extent, lost job of 17yrs for same company but 2 different franchise 7yrs at the one where i hurt myself, never work again have to pay for all my medicials, lost just about everything i worked 22yrs for (savings, cars, bikes & just hanging on by a thread with my home, when i was receiving work cover payments they weren’t taking enough tax out and ended up with a debt of $38, 000 yes 38 grand and even the tax man has no compassion daily interest and shit. Im 46 my injury i was 39 currently a great life hey and the system wants to ram me more and more and more. we need to be HEARD as a group i think..

    if you are being assessed for anything other then heart… at all cost side step Dr Myers (heart surgeon) he is in competent to assess anything other then heart i carnt understand his method to test the feelings in legs : by running 2 fingers down the leg, i have rammed pins, 34 guage needle im my legs drawn blood and had specialists horrified that i could feel a thing yet DR Dickhead sorry Myers reported there was nothing wrong with my numbness to BOTH legs ( yes both legs mid thigh down thats a mystery for them all as well)

      I was 38 in my prime, now 45. Cant remember my kids growing up or the last 7 years much at all.
      Problem with fighting this is i need capacity and that also means not being dazed with legal drugs.
      I just need help to do this but so desperately want to bring honesty and justice to a horrible horrible system.

  8. Hi! That’s great. I’m interested in joining, class action against WorkSafe/insurance companies etc, and making a lot of noise about what’s really going on.

    The government and their commercial cronies’ treatment of injured workers (hence the disabled and vulnerable) is illegal, disgusting and unacceptable. A shock to find out what happens in practice, as opposed to theory/rhetoric/laws/publications/false promises.

    Injured workers are all on their own against massive government-protected fraudsters. Justice is achieved by some of those who can get through court in one piece, with no income and with everyone (“WorkSafe,” insurance maggots, dodgy doctors, lawyers, Centrelink, etc) trying to stomp them down through the cracks so they can’t defend or access their legal rights. Meanwhile, the lawless are free to break laws and ruin people.

    Hell, I’m even interested in vigilantism at this stage. Anybody?

      • Class action is overdue. And I have proof of WorkSafe corruption and gross abuse of power in my case. Nobody can look at my evidence and make any excuses for WorkSafe. I made sure they had no way of excusing themselves, including by spelling everything out clear enough for baboons to understand in my WorkCover statement. They ignored all facts and evidence to reject on three points that conflict with the law and reasonableness. Same with the fake inspection they bumbled through.

        We need to organise, we need to refuse to allow these bastards to silence is or abuse our rights and the law, and we need to take collective legal action. Harder to argue with hundreds or thousands of people who have had the same experience.

        • I fully support a class action. I suffer with horrible spinal pain from neck down to T8 following being crushed at work nearly 7 years ago. The insurer QBE now Xchanging both have engaged in gaining less than truthful IME’S from so called doctors who are simply out of their league in chronic pain; opiate and other pain medication and mental issues associated to both the above. I dont need an insurer belting me with a stick so to speak when i am at suicidal levels so regularly due to pain, my lack of ability and the effects of medication distorting my mental capacity.
          This has been complete hell and being essentially told either your a liar (indirectly), or just get on with it -when you simply cant cope, unfortunately pushes me to the only way to turn it all off. I simply cant understand how cruel and callous people can be in the name of making a dollar.
          I too have full medical support from my team but it seems the insurer has complete disregard to professional advice.
          I recently had a nerve stimulator implant installed and not being given required time to work through programming which is very slow and intricate nor time to adjust and hopefully get off or change medications (as implant has only Reduced one of x3 areas), I remain unable to physically and mentally cope.
          If only someone in the system with power had lived with such pain just maybe others could understand -as i would go so far as to say there is no way i could comprehend the suffering without enduring it myself.

      • The Police prosecute criminal matters. Scheme abuses is regulated by theVictorian WorkCover Authority. Yes they self-regulate, now wonder things are fuc…ed!

    • yes, very interested. I am concerned this site is being hacked by doctors. Check the list – curiously, all the ‘good’ ratings for some doctors have been made on the same dates as the ‘good’ ratings for Dr du Plessis, who has been reported in the media to be questionable. It seems like someone is seeking to manipulate these results for this list. I am not contactable on this email….

    I’m sorry to hear you are being so unfairly screwed by the unlawful, corrupt government and their unlawful, corrupt cronies. Remember, corruption is illegal and they are meant to be held to account.

    The state governments are corrupt, negligent at the best of times, and criminal at the worst. They are DEFRAUDING people like us of money that legally belongs to us. We are talking about white collar CRIME.

    Have you kept evidence of being defrauded on invalid grounds? Have you written to your MP? Have you written to the state Ombudsman? Have you made a protected disclosure to your state anti-corruption commission?

    I note that after calling a WorkSafe Victoria inspector out on corruption, I cannot get them to respond and she (Pam Curslake) keeps trying to fob me off to someone else to find out if Pam did something she said she would or not. Yep, they are corrupt as f***, and while happy to help ruin innocent people’s lives, they are too pathetic and cowardly to handle so much as a question once called out.

    Try to understand Troy, it’s not that “these dickheads don’t see”. They do understand exactly what is going on and what they are doing. But they are criminals and obviously psychopaths.   11. i agree 100% theres plenty of corruption with in the system, ive been shafted big time 7 yrs it has been going on for and now its in the hands of another lawyer, how can one be knocked over by a overhead crane (faulty due to brake failure) snap not tear all ligaments, in need of a knee replacement, have chronic pain daily & after 7yrs carrying my R knee my left now needs surgery ive, the only treatment i have left to try is a dorsal fin (50K) and have to sell my house for that money & still not a 100% of improvement, Ive been deemed never to return to any employment in todays market (as they say) & have been since 2010 lost 40-50k per year in wages + super in the last 7yrs and work commision still says im 4% permanet impairment 9yet the board wont asses me directly) there decision over rides the 4 reports from different specialist & countless reports from knee, pain specialist. . These dickheads dont see what goes on inside my walls the countless days in bed, hours & hours laying in hot baths trying to feel some type comfort, the mental strain of being injured let alone feeling low from unemployment, ive worked since the day i left school paid my taxes, insurances, supported my family to nearly on the streets from these corrupt arseholes, its destroyed my life my dignity and so much hate-tread towards the government and the system its as corrupt as f**K FTS

  12. It’s my guess that most of the WorkCover lawyers are scoundrels. Just like most IME’s and most employers.

    The whole system is set up to defraud injured workers, not to help them. WorkSafe is a Ponzi scheme. Ponzi schemes do not deliver what they promise, but exist to defraud people.

    If WorkSafe was not a Ponzi scheme:

    – would WorkSafe pay lawyers up to $1 million a year to minimise their own paying clients’ access to their LEGAL ENTITLEMENTS? Clearly not.

    – would WorkSafe pay insurers incentives to reject VALID CLAIMS? Clearly not.

    – would WorkSafe pay IMEs exorbitant amounts to issue FALSE DIAGNOSES? Clearly not.

    – would the state governments respond to repeated investigations and enquiries highlighting the same corruption only by tightening legislation to strip genuinely injured workers of more of their LEGAL RIGHTS? Clearly not.

    – would the Victorian government have stolen $500 million of funds raised for and DEFRAUDED from injured workers? Clearly not.

    This is not a system set up to help injured workers. From many accounts the system exists to abuse and defraud injured workers, and there are plenty of medical professionals with both integrity and experience with the system who acknowledge this.

    Sure, fighting the system MIGHT eventually result in you winning your legal entitlements, but probably not before it destroys you and any prospect of salvaging a future.

    Look to other avenues. FairWork. Human Rights legislations and bodies (but expect these to be corrupt too – see if you can pursue this via FairWork). Your state Ombudsman. And your state anti-corruption body such as IBAC and ICAC.

    Spell out everything in writing during your claim, and on your claim form. Address all bullshit when applying for senior review. Don’t leave the insurer any room for “error,” omission or bullshit justifications, rhetoric and spin. If the insurer and WorkSafe then reject your claim on corrupt, invalid grounds and you cannot get them to address this, you should have a body of evidence of corruption to send your anti-corruption body.

    Fight back, but try to do it on your terms. This system is set up to destroy you, not to be just, lawful, fair or helpful. WorkSafe is just a Ponzi scheme for corrupt assholes to benefit from.

      – Investigate cases of WorkSafe corruption and slimy practices, so you can see what may lie ahead for you. Certainly check out Ron Fenton. Here’s a guy who absolutely should not have had to fight for his legal entitlements. When he finally did win, they just changed the rules at court to deprive him of his legal entitlement. Worth the fight? Obviously not. (This doesn’t mean you shouldn’t pursue them… Just not through a system set up to screw you. Look for systems set up to hold corrupt maggots accountable.)

      – Make sure you read and educate yourself on relevant laws, including your state’s OHS Act and WIRC Act, and the FairWork Act and its General Protections. Austlii is a fantastic web resource for this. Also read relevant case law to see how judges have applied the law in similar cases. Even WorkSafe itself will OUTRIGHT LIE to you about the law. You are a human being with inherent and legal rights. Know what they are and defend them! Nobody else will try to protect your rights rather than try to deprive you of them. All these maggots take advantage of vulnerable people’s positions and attempt to push people into more of a vulnerable position so they can take further advantage. These people are sick and I’m sure psychopathic. Could you do the unethical and sometimes unlawful things they do to destroy people for their own financial benefit? If you’re normal, probably not!

      – Read and save your state’s WorkSafe pamphlets etc relevant to your injury. If what WorkSafe says on paper doesn’t match what it tries to insist to you, this equals deceit and corruption. WorkSafe is lying to you to DEFRAUD you of YOUR LEGAL ENTITELEMENT which it wants to share with fat cats instead.

      – Keep everything! Sometimes it will not become clear until later that a piece of documentation evidences corruption, where corruption has not yet become apparent. I have had many things become clear later, and have every email, text message and voicemail. This is the only positive in my case, and I have irrefutable evidence of WorkSafe corruption and also of WorkSafe conspiring with my employer to reject my claim based on lies rather than fact and evidence (although some of this was obtained by mistake and wasn’t supposed to be given to me).

      – Remember that these maggots are supposed to be accountable, and are breaking the law when they reject valid claims on invalid grounds and conduct themselves corruptly. Be resolved to hold the bastards to account at the end of the day, and collect evidence for these purposes as you watch them hang themselves with their unjustifiable conduct.

Everybody says you have to get a lawyer and so far, without one, I have been deprived of my legal entitlements and subjected to further abuse of my rights by the WorkSafe insurer and WorkCover Victoria. I finally got a complaint through the gatekeepers at WorkSafe Victoria and the inspectors merely helped the employer with their cover up.

    Do I need a lawyer? Yes. Am I prepared to fight via the WorkSafe system? Absolutely not! I will not pay a lawyer to access even less of my entitlement with no guarantees the whole system isn’t corrupt including the courts. I mean, even your own lawyer could be in receipt of bonuses from WorkSafe to minimise your compensation. (Unlawful and a conflict of interest, but this happens as with every other corrupt thing.)

    So if you, like me, refuse to engage in the abusive WorkSafe system that threatens to destroy you more than anything else, what are you options?

    Look into the FairWork Act and General Protections. Can you seek resolution via FairWork (including the courts that deal with cases if you don’t agree to conciliation and jump straight to court)?

    Re WorkCover system, you can:
    – write to your local MP and relevant MP’s. Keep copies to prove that you’ve brought unlawful and corrupt conduct to their attention and they were negligent, if they ignore you.
    – lodge a complaint with the state Ombudsman.
    – lodge a complaint with the state anti-corruption body. Make sure you do so via a protected disclosure avenue so the government cannot victimise you for making a complaint. And check out the law governing your anti-corruption body. Eg in Victoria, the IBAC will need some evidence upfront to show that there is something to investigate, although I believe they are now able to investigate on strong suspicion. However, you want to make sure you provide enough evidence so that they are able to investigate according to the relevant anti-corruption body’s regulating law.
    – write about your experience on the internet persistently.
    – start a group petition by many injured workers to raise awareness and pressure the governement to address the issue in good faith instead of trying to screw injured workers over more and more. If a large group of injured workers did this, it would be very effective.
