Xchanging case manager: at best terrible, at worst bunch of bullies

Yesterday we received the shameful story of “Severely Injured” who, rightly, describes his Xchanging case manager as a crazy ex-girlfriend who went from my ‘new best friend’ to nothing short of a stalker. She
would ring the injured worker up to 8 times a day, and berate him, scream abuse, make outrageous claims – “I am stopping your payments, its up to me, and you are getting nothing, which is what you deserve”…Sound familiar? You bet! And here is what you can do about it!

Holy Schmoly- our site was hacked

As you may have gathered, our site was hacked last month and malware was found. The trouble started shortly after we received an email from a -clearly- very disgruntled IME, referring to his multiple negative reviews on our site’s “rate an IME / IME List“, and stating that we caused upset in those injured workers who were due for an IME assessment with this man. He demanded an apology and requested we delete the reviews pronto…or else… Coincidence? Maybe…

WorkCover insurance doctors – Dr Doron Samuell

Although 5 years ago, it is worth re-publishing that The Hon. A. Bressington stated she had been approached by a number of constituents on WorkCover, who have been required by their case manager to appear before Dr Doron Samuell, a fly-in “independent medical examiner” from New South Wales. Each has alleged that the behaviour of Dr Samuell was intimidating and bullying, that he inappropriately filmed meetings without seeking their permission, that there was yelling and finger-pointing, and that he behaved in a threatening manner towards the injured workers.

Workcover stress claims can be extremely challenging to file and to litigate against. And they are getting tougher and tougher. There are many legal requirements that need to be satisfied in order to have a viable case. In order to submit a WorkCover claim for stress, it’s necessary for your legal team to demonstrate that you have suffered an ‘injury’ – at work – and within the meaning of the WorkCover legislation. This means you cannot typically claim for experiencing stress as an emotion, but rather, you are suffering from a clinical medical condition.
