WorkCover NSW private insurers contracts

Thanks to Annieprimrose, it has come to our attention that WikiLeaks released a copy of most of the contract documents between the workers compensation insurer, controlled by workcover NSW, and private companies. According to Wikileaks’ source, the files are important as until now the workers compensation arrangement between insurers and the government has not been transparent.

WorkCover NSW private insurer contracts

The files contained in this zip file are a copy of most of the contract documents between the Workers Compensation Nominal Insurer, controlled by the WorkCover Authority of New South Wales (WorkCover NSW) and private insurance companies who act for the government in the delivery of workers compensation services in the State of NSW, Australia.

These private insurers are:

  • Allianz Australia Workers’ Compensation (NSW) Limited
  • Cambridge Integrated Services Australia Pty Ltd
  • CGU Workers Compensation (NSW) Limited
  • Employers Mutual NSW Limited
  • Gallagher Bassett Services Pty Ltd
  • GIO General Limited
  • QBE Workers Compensation (NSW) Limited

According to Wikileaks’ source, the files are important as until now the workers compensation arrangement between insurers and the government has not been transparent.

This lack of transparency meant that an insurer could act contrary to its obligations under the agreement and an injured worker would not be aware of this, thus perhaps impeding an injured workers ability to protect his or her rights in any matter.

About Workcovervictims

We are the authors, co-authors, seriously injured workers and invisible supporters (incl. abled family members and friends) behind A Diary of a WorkCover Victim. We hope this site, our and many other injured workers’ stories will somehow help other injured workers navigating the murky waters of the workcover system, and, at the very least, teach you to be extremely diligent in finding out your legitimate rights, always questioning the “system” in order to keep some sort of control within the workcover system. The workers compensation is – in our opinion- extremely adversarial and they use tactics to wear you down, to make you emotionally bleed out, to break you, all in order to weaken your position and to maximise their insane profits.

Complete Transparency would be nice !
Unfortunately these insurance companies are not!
When you challenge them with their own policies and procedures they panic and try to hide behind
    ” legislation ” !!
Why don’t these insurance companies address the issues, when questioned, about the qualifications of the case managers !
These lovely people, what actually are their qualifications to assess you ?
You are either met with silence or are ignored or they write back that these case managers are qualified without exactly stating what their actual qualifications are ie Diploma, Certificate etc.
It is worrying isn’t it !

Worrying? I’d say it’s sickening? And saying that these uneducated clerks are let totally loose is the true scary part! They make decisions about our LIVES, they play GOD and are above the LAW, and.. oh.. also always way more qualified that even our top medical experts, whose opinions and treatment get “questioned” by sending us to geriatric “experts” in totally unrelated medical fields.
I still remember having been told in writing by my pathetic case manager, after she had personally spoken with my shoulder surgeon, who is one of the very few people in Australia to be exclusively super-specialised in upper limbs (and teaches the art) that “there was need for an “objective” assessment and opinion”. She sent me to an 85 year old “IME” trained in general surgery (as in warts, gall bladders, bowels) for that “opinion” of my very complex and rather unique orthopedic injury, which a normal orthopedic surgeon cannot even manage…
I will save you the “opinion”.
It is INSANE. It is OUTRAGEOUS and sickening because these “clerks” actually make decisions about YOUR life (and death) to the point of endangering your life (i.e. by delaying treatment, surgery etc).

Please be aware that the above documents have now been superseded by new scheme agent contracts, most of which are available on the WorkCover NSW website.

WorkCover does appear to be hiding some of the contracts though.

If it wasn’t for wiki leaks and other whistleblowers none of us would really know the depths of dishonesty happening in our governments. Some of the leaks are questionable but if there is any dishonesty on behalf of these people it should not be difficult for those accused to become transparent and vindicate themselves. The thought of having a bunch of TNC’s (transnational corporations) in control of my country when they didn’t run for election ( and I would not vote one in) but came to power through the back door via manipulation is sickening. That the laws are violated to suit them and the laws are only followed to silence voters. Certainly makes me wonder. Whistleblowers should be supported. Only recently the truth about our whistleblowing laws have revealed they are constructed to silence the truth. A honest government would be ammending theses laws immediately. What a way to prove their party supports transparency. I would vote for any government who had the intestinal fortitude to step out and make that change! So would millions of “honest” Australians. The scenario is simple. Play by the rules “you made”
