Another worker dies as O’Farrell rewards employers with low premiums

Another worker has died this morning after being trapped under a forklift at the Sydney Markets.

The worker died at the scene in Flemington, in the city’s inner west, about 5.20am today, a NSW Police media spokeswoman said.

A coronial report is being prepared but WorkCover will handle the investigation.

As the OFarrell government beats their chest about rewarding employers with low premiums and anti worker workers compensation laws it seems bosses still cant prevent injury or death on the job.

“This is horrendous” says Injured Workers Support Network facilitator Michelle Burgess.”the third worker killed on the job since the OFarrell government embarked on its campaign to slash benefits to injured workers and their families.

Unfortunately for this family not only have they lost a loved one but there will be no compensation for the family for the stress and trauma caused to the family.”

“While injured and ill workers are the recipients of some of the worst workers comp reforms ever  seen in this state, employers continue to injure and maim workers with no apparent repercussions” says Ms Burgess.

The Injured Workers Support Network extends its sympathy to the family and friends of the worker killed and calls on Barry OFarrell to take action against employers who cause  work place death.

About Workcovervictims

We are the authors, co-authors, seriously injured workers and invisible supporters (incl. abled family members and friends) behind A Diary of a WorkCover Victim. We hope this site, our and many other injured workers’ stories will somehow help other injured workers navigating the murky waters of the workcover system, and, at the very least, teach you to be extremely diligent in finding out your legitimate rights, always questioning the “system” in order to keep some sort of control within the workcover system. The workers compensation is – in our opinion- extremely adversarial and they use tactics to wear you down, to make you emotionally bleed out, to break you, all in order to weaken your position and to maximise their insane profits.

Blood is on your Hands Barry O’Farrell.

One can only hope YOU are Haunted and Tormented for the rest of your Day’s.

Barry  don’t make the work place safer just appease the Insurers that have lobbied  your Pathetic excuse of a Political Party with more powers and more wealth.

As John McPhilbin rightly stated in an email to me, “I wonder if Mr O’Farrell has considered the fact that workers won’t risk putting their lives and health on the line in many government projects where health and safety is in question? (see our previous article http://aworkcovervictimsdiary.com/2012/06/last-year-workcover-nsw-worksafe-outlined-alarming-costs-workers-comp/)

“It will be interesting to see future costs to projects due to delays and other cost overruns? Safety first is something this government has forgotten – prevention is better than cure.”

    Barangaroo workers walk off job

WORKERS have walked off the job at the NSW government’s $6 billion Barangaroo development after asbestos was found for the second time at the site.

Construction Forestry Mining and Energy Union assistant secretary Rob Kera said between 30 and 40 workers stopped excavating after asbestos was found at the southern end of the project, where two office towers to house tenants Westpac, KPMG and Lend Lease would be constructed.

“Trucks have been driving over the asbestos and spreading it around the site and we have workers who are on jobs right beside the asbestos,” he said.

“There is no doubt there is still a substantial amount of asbestos on this site.”

Lets not forget the cost blow out to all Greenslips now that journey claims have been abolished. Expect to pay because the insurance companies will not absorb the additional claims that will go through.

Excellent point – there are going to be so many (and very costly) consequences that this government is really going to feel the pain, I’m sure.

I have now heard that there are a number of Barristers and Legal firms who are banding together as the majority of these changes are unconstitutional and will be taking it to the high court.

My understanding is it won’t stop the laws starting but once they have a decision from the high court,  then changes will need to be made again.

So Barry is about to embark on a more costly journey, which will see a number of  his changes deemed Unconstitutional, who will he blame then, who will foot the costs. The simple solution for this incompetent government is to stop and address the real issues, the issues brought forward from injured workers and doctors rather than listen to what the insurers want.

The NSW Liberal Government will be one term Government the only problem is it can’t come soon enough.

There has to be a legal challenge to these laws, they are grossly unfair. And there should also be an investigation by the ICAC into irregularities like Robert Borscak (Shooters Party) having an interest in a company which makes software for insurance companies. How much payback is going to politicians for deals with the insurance companies? How about an investigation into the procedures used to pass these disgusting ‘amendments’ which are retroactive. Like I was told by a member of Barry’s party – ‘I have not read the legislation yet’ and he voted on it !!!
